Florida Condo Common Elements

Florida Statutes 718.103(8) shows “Common elements” means the portions of the condominium property not included in the units.

One simplistic way to describe a condominium is as a property of two parts:

  1. Condo units, exclusively owned by the buyers of each unit, and
  2. Common elements, which are any areas not included within the unit boundaries. Unit owners also own an undivided share in the common elements.

The association, usually, maintains the common elements as a common expense, while the unit owners are each responsible for their individual units at their own expense.
